Seller guarantees that Puppy is in good health and has received appropriate medical vaccinations and care including parvo vaccinations and worming. Seller will provide Buyer with a medical chart detailing treatment Puppy has received under Seller's care and future care Seller feels is essential to Puppy's well being. II. Seller guarantees that Puppy is free of life threatening diseases or disabilities (i.e., heart murmurs, parvo, etc.) for 72 hours after delivery to Buyer. Should life threatening diseases or disabilities be discovered by Buyer within 72 hours of receipt of Puppy, and attested to in writing to Seller by Buyer's veterinarian, Seller will provide Buyer with a replacement puppy of equal quality and value as soon as such a puppy is available to Seller, or refund 100% of purchase price ($). The Seller warrants that the above-described puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within 72 hours (not including weekends or holidays) of receipt of the puppy. III. If, as a result of the examination, the Veterinarian determines that the puppy is not in good health, then the Buyer shall elect to keep the puppy or return the puppy to the Seller for a refund. If the Buyer elects to return the puppy, the Buyer shall within 10 days after the date of the signing of this contract, send to the Seller, by certified mail, a written Veterinarian's certificate stating that the puppy was in ill health when examined. Upon receipt of the puppy, the Seller shall be obligated to refund all monies received from the Buyer toward the purchase of the puppy, and further performance under this contract shall be null and void. All action taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at time of shipment, non-stop flights, etc. IV. The Buyer agrees that any and all transportation costs, to and/or from the Seller's premises, and all Veterinary fees, will be at the cost and sole responsibility of the Buyer. V. The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: vaccinations, internal as well as external parasites, heartworm preventative medication. VI. The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of it's progeny to any agent, pet store, or puppy mill. VII. The Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies. VIII. Should the Puppy be diagnosed with in the first 12 months of life with any congenital or genetically derived medical disorder which is considered by two unassociated veterinarians to be life threatening. Seller will, upon provision of veterinary reports (autopsy report by an accredited Diagnostic Lab is required if the puppy dies), provide Buyer with replacement puppy of equal quality and value as soon as such a puppy is available to Seller. This guarantee does not cover any non life threatening and/or treatable conditions including but not limited to elongated soft palate, demodicosis, allergies, spinal abnormalities, luxating patella, orthopedic hip or elbow problems, hypoplastic trachea, entropion or cherry eye. IX. The Buyer agrees that the puppy will NOT be left alone in a backyard or kennel only. The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or "tied out". This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family. X. There is no guarantee or warranty that the buyer will be able to show or breed the puppy regardless of show or breeding potentials. This Agreement is made and signed by both parties to insure the well being and protection of the puppy. If any part of this Agreement is breached, the Seller is released from any further obligations hereunder. This contract applies to the original puppy only and is nontransferable to a second party. Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court fees.
